Dallas, TX: A Dallas, Texas court awarded a local woman more than $58,000 after determining a Dallas-area used car dealer sold her a salvaged vehicle without her knowledge, violating the Texas Deceptive Trade Practices Act.
The final judgement was signed on April 15, 2022 in the 116th District Court, presided over by Hon. Mary Murphy. The judge not only awarded plaintiff Bushra Khan $58,638.75 in damages, but also decided the defendant Motorsports Auto Group LLC must pay Khan’s attorney’s fees as well.
Allen Stewart P.C. attorney Kendra Pfeil, who represented the plaintiff in in Bushra Khan v. Motorsports Auto Group LLC, said Khan bought the vehicle from Motorsports Auto Group in April 2021. The dealership never disclosed the vehicle’s salvaged status and falsely told Khan the vehicle’s original factory warranty still protected it. When the vehicle started experiencing mechanical problems, Khan took the vehicle to a local Toyota dealership where she learned the vehicle was, in fact, a total loss and was no longer protected by its original factory warranty.
Motorsports Auto Group continued deceiving Khan, claiming the multiple illuminated warning lights in the vehicle indicated only a “software issue” and they would take it to a Toyota dealership to fix it. They kept the vehicle for three months while refusing to update Khan on its location. After taking it upon herself to call local Toyota dealerships, she eventually found the vehicle and discovered the vehicle’s damage was far more extensive than she was told and the vehicle’s warranty had long since expired.
Pfeil said Motorsports Auto Group refused to respond to the suit filed by Khan, and thusAllen Stewart P.C. obtained a default judgement for liability and damages for her.
“Just because a dealership does not respond does not mean they can get away with deceptive practices,” Pfeil said. “I am proud to see the Dallas legal system find justice for Ms. Khan.”
